WHISTLEBLOWING POLICY

WHEN TO USE THIS DOCUMENT

This policy sets out the parameters within which the Public Interest Disclosure Act 1998 will apply within an organisation. It illustrates how an organisation deals with whistle blowing – i.e. providing employees with the confidence to reveal any concerns they may have about the conduct about the organization and of anyone working within it.

This policy is intended to cover major concerns which are NOT covered by any other complaint or grievance procedures. It sets out both how a business understands and meets their legal obligations and maintains the rights provided by the law.

All of our policies combine professional legal and personnel / HR knowledge with practical experience in business to provide an easy to use policy which meets with legal responsibilities and obligations.

A written policy like this one helps employees to understand what whistle blowing is and how the organisation provides a way for employees to raise those concerns and to be informed about any action taken without any fear of retribution etc. It explains what “qualifying disclosures” under the legislation are and the procedure for dealing with them, including, as applicable, maintaining anonymity and confidentiality whilst providing reassurance.

THIS DOCUMENT CONTAINS THE FOLLOWING:

It covers the issues that such policies need to deal with including:

  • Policy aims and an explanation of what is meant by the legislation and “qualifying disclosures”.
  • Awareness of the impact of legislation.
  • Commitment to compliance.
  • HOW CONCERNS / “QUALIFYING DISCLOSURES” should be raised.
  • How the organisation will respond to them.
  • Anonymity and confidentiality.
  • Policy monitoring and review.
