APPOINTMENT OF AN ARBITRATOR AFTER DISAGREEMENT

WHEN TO USE THIS DOCUMENT

 This document is an agreement made between 2 or more business parties who are working together in some way. This may, for example, be in a joint project they are working on together or could be when one party is supplying products and services to the other.

 The agreement deals with the situation when a problem and potential dispute has occurred whilst it remains unresolved, is costly and can have a serious effect on business.

 The agreement appoints a representative from each of the parties and sets out the circumstances of how the potential problem or dispute will be dealt with. It contains an easy to follow procedure from a final meeting of the representatives to try and reach a resolution through to an appointment of an arbitrator if that final meeting is unsuccessful.

 The arbitrator is professional who will arbitrate between the parties but will make a decision as to how the issues will be resolved.

 The agreement contains time limits so that disputes do not go unresolved for a long period of time and deals with such as issues as payment of the professional arbitrator’s costs.
