APPOINTMENT OF A MEDIATOR - BEFORE ANY DISPUTE


WHEN TO USE THIS DOCUMENT

 This document is an agreement made between 2 or more business parties who are working together in some way. This may, for example, be in a joint project they are working on together or could be when one party is supplying products and services to the other.

 The agreement recognises that problems and potential disputes can occur which, when unresolved, are costly and can have a serious effect on business.

 The agreement appoints a representative from each of the parties and sets out the circumstances of how any potential problems or disputes will be dealt with. It contains an easy to follow procedure from a final meeting of the representatives to try and reach a resolution through to an appointment of a mediator if that final meeting is unsuccessful.

 The mediator is professional who will act as an independent third party to help the parties reach a resolution as to how the issues will be resolved.

 The agreement contains time limits so that disputes do not go unresolved for a long period of time and deals with such as issues as payment of the professional mediator’s costs.
