BUILDER’S TERMS AND CONDITIONS

WHEN TO USE THIS DOCUMENT

 These standard terms and conditions are for use when selling building services (material and labour). The terms will cover the basics of most sales to businesses or consumers, so it does not matter if you are selling face to face when you meet someone, or from a website or at a distance (over the telephone etc).

 Standard Terms and Conditions set out the basics of how you will supply your building services. So, for example, it will deal with your obligations and what you supply but will also deal with the buyer’s obligations and responsibilities (for example, if they supply information or measurements which you rely on and use).  It also covers potential issues such as there’s a problem with payment etc.

 The document has various options so you can customise it to suit what you need. For example, you can decide whether you want the buyer to pay before you supply or pay within 7 days of you providing an invoice etc.

 Standard terms and conditions are normally be accompanied by a proposal document which is used to detail of exactly what that particular customer is buying (exactly what you are selling them, what the price will be, when it would be supplied etc).

 Together, the documents set out the terms and conditions of sale which the builder wants the customer to agree to and so must be available for all buyers to read before they agree to buy. They should be part of the ordering process and available to read before the order is placed.

 The usual information you would expect to see in terms and conditions like these which you customise, including:-

• Information that you MUST include.
• Usual payment terms and what happens if payment is late or is refused etc.
• Buyer’s responsibility and obligations.
• Supplier’s responsibility and obligations.
• Distance Selling rights.
• Cancellation and termination.
• Limitation of liability.
• Warranty.
• How and when payment is usually made.
