WHEN TO USE THIS DOCUMENT

 This pack contains all a fitter or someone providing kitchen fitting services needs to provide Proposals or quotes and terms and conditions of business. It also contains a letter to enable you to chase for non-payment.

 It contains 3 documents:

 - Standard terms and Conditions
 - Proposal
 - Debt letter – Non-Payment

Standard terms and Conditions

 These standard terms and conditions are for use when selling kitchen fitting services (material and labour). The terms will cover the basics of most sales to businesses or consumers, so it does not matter if you are selling face to face when you meet someone, or from a website or at a distance (over the telephone etc).

 Standard terms and conditions are normally be accompanied by a proposal document which is used to detail of exactly what that particular customer is buying (exactly what you are selling them, what the price will be, when it would be supplied etc). If you want to vary your standard Terms and Conditions for a particular customer (for example, you want to give them more time to pay you), you can do this on your Proposal. This limits misunderstandings.

 The document has various options so you can customise it to suit what you need. For example, you can decide whether you want the buyer to pay before you supply or pay within 7 days of you providing an invoice etc.

Proposal

 Standard terms and conditions are normally be accompanied by a proposal document which is used to detail exactly what that particular customer is buying (exactly what you are selling them, what the price will be, when it would be supplied etc). If you want to vary your standard Terms and Conditions for a particular customer (for example, you want to give them more time to pay you), you can do this on your Proposal.

 So the Proposal is used to set out exactly what you are offering before an order is placed by that customer / client so there are no misunderstandings about what is available and on offer. The customer accepts the Proposal when an order is placed.

 A Proposal can also be used as a form of quote.

 Together, the documents set out the terms and conditions of sale which the seller wants the buyer to agree to and so must be available for all buyers to read before they agree to buy. They should be part of the ordering process and available to read before the order is placed.

Debt letter – Non-Payment

 We are also including a non-payment letter demanding repayment of money that the fitter is owed. The letter is intended to give the debtor a final chance to make payment that is due but also warns that if they do not make payment, then the fitter will be issuing court proceedings to recover the money due. For this reason it is also called a “letter before action”.

WHAT DOES IT CONTAIN?

 The usual information you would expect to see these types of documents which you customise, including:-

 The Standard Terms and conditions:

  • Information that you MUST include.
  • Usual payment terms and what happens if payment is late or is refused etc.
  • Buyer’s responsibility and obligations.
  • Supplier’s responsibility and obligations.
  • Distance Selling rights.
  • Cancellation and termination.
  • Limitation of liability.
  • Warranty.
  • How and when payment is usually made.

 The Proposal:

  • Information that you MUST include.
  • Sections for you to customise so that you can describe exactly what you can supply and at what price and when payment must be made.
  • Time estimates.
  • How and when payment is to be made.
  • A schedule which will enable you to vary or add to your businesses usual terms and conditions.

 The letter allows the fitter to specify:-

  • The interest that has accrued.
  • What amount is due.
  • The date when it must be repaid by.
  • How it must be repaid (you choose, for example, to demand payment by bank transfer).
